Section 01 Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the website located at www.peakscaling.site and any related services, content, and communications provided by JW Pinnacle Management LLC (“JW Pinnacle Management LLC,” “we,” “our,” or “us”). By accessing our website, submitting a form, or opting in to receive messages from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

Section 02 Our Services

JW Pinnacle Management LLC provides done-for-you marketing services for local blue-collar service businesses, including branding, website development, Google Business Profile optimization, review management, and CRM and lead tracking. The information on our website is provided for general informational purposes only. Specific services are provided pursuant to a separate written agreement or engagement that describes the scope, pricing, and terms of that service.

Section 03 User Information & Accounts

When you contact us through our website or otherwise, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any login credentials you use to access our services, and for all activity that occurs under your account. Section 04 SMS Program Terms

By opting in to receive text messages from JW Pinnacle Management LLC, you agree to the following SMS program terms. These terms apply in addition to, and do not replace, our general Terms and our Privacy Policy.

Program Description

JW Pinnacle Management LLC operates an SMS program that sends text messages to subscribers who have provided prior express consent. Depending on the consent you provide, you may receive:

• Transactional / service messages. Strategy call confirmations and reminders, client onboarding updates, monthly report notifications, deliverable alerts, account updates, and replies to inquiries you initiate.
• Marketing messages. Special offers, service updates, client wins, and educational content for blue-collar business owners, sent only to subscribers who separately opted in to marketing SMS.

Marketing and transactional consent are collected separately. You may opt in to one, both, or neither. Consent to receive SMS is not a condition of purchase or of receiving any product or service from JW Pinnacle Management LLC.

Cancelling Your Subscription (STOP)

You can cancel the SMS service at any time. Simply text “STOP” to the phone number from which you received the message. After you send “STOP,” we will send a single confirmation message acknowledging your unsubscribe request. Following this confirmation, you will no longer receive SMS messages from that program. If you are subscribed to more than one program (for example, both marketing and transactional), you may need to reply STOP to each program from the relevant number.

Rejoining

To rejoin an SMS program after you have unsubscribed, sign up again using the same method you originally used to opt in (for example, by submitting the form at www.peakscaling.site), and we will resume sending SMS messages to you.

Carriers & Delivery

Carriers are not liable for delayed or undelivered messages. We make reasonable efforts to deliver messages promptly, but we cannot guarantee delivery times. Supported carriers may change from time to time without notice.

Message Frequency, Fees, and Rates

Message frequency varies based on your interactions with us and the type of program you have subscribed to. As always, message and data rates may apply for messages sent to you from us and to us from you, according to the rate plan you have with your wireless carrier. For questions about your text or data plan, contact your wireless provider.

Privacy

For information on how we handle the personal information we collect in connection with the SMS program, including the specific statement that no mobile information will be shared with third parties or affiliates for marketing or promotional purposes, please see our Privacy Policy.

Section 05 Acceptable Use

When using our website or services, you agree not to:

• Violate any applicable law, regulation, or third-party right.
• Use the website or services to transmit any unlawful, fraudulent, defamatory, or harmful content.
• Attempt to gain unauthorized access to any portion of our systems, other user accounts, or any connected network.
• Interfere with or disrupt the integrity or performance of our website or services, including by introducing viruses or other malicious code.
